By accessing or using the Charleston Bonsai website at charlestonbonsai.com (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and anyone who accesses or uses the Site.

02What we do

Charleston Bonsai is a working nursery specialising in the cultivation and sale of bonsai specimens. The Site presents our catalog, allows visitors to browse available trees, and offers ways to write to us to schedule an appointment or to inquire about a specific tree. We also maintain business pages on Facebook and Instagram for updates and community engagement.

03Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the Site in any way that violates applicable local, national, or international law
• Transmit unsolicited or unauthorised advertising or promotional material
• Attempt to gain unauthorised access to any part of the Site or its related systems
• Use automated tools (bots, scrapers) to extract data from the Site without our prior written consent
• Impersonate Charleston Bonsai or any of its staff

04Purchases and transactions

All sales of specimens are subject to availability. Prices displayed on the Site are subject to change without notice. Purchases are finalised through direct communication with our staff, either in person at the nursery or by email.

We reserve the right to refuse service to anyone for any reason at any time. All sales are final unless otherwise agreed in writing. Because the trees are living organisms, we strongly recommend discussing care requirements before purchase to ensure a successful match.

05Intellectual property

All content on this Site — including text, photographs, graphics, logos, and design — is the property of Charleston Bonsai or its content suppliers and is protected by applicable copyright and intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

06Social-media content

Content we post to our Facebook and Instagram business pages is owned by Charleston Bonsai. By interacting with our social-media pages — commenting, sharing, or tagging us — you grant us a non-exclusive, royalty-free licence to use, display, and share that content in connection with our business. We will always credit you when sharing user-generated content. Your use of those platforms is also governed by Meta’s own Terms of Service.

07Disclaimer of warranties

The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

08Limitation of liability

To the fullest extent permitted by law, Charleston Bonsai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.
